Since they have left the terms to be ambiguous, they can train their models on your "not published" content. Who'd know what's going at the backend. OpenAI is facing similar legal issues for training their model on Copyrighted Books and Publishes without any consent of the publishers. The law is not in place yet for AI and hence it will be misused by the Companies, later on paying just fines as "Neither Acceptance nor denial" charges.
