Firstly, ofcourse there are many wage slaves lying around, who would grab the position because they can be "slaves" in the country where the number of unemployed individuals is crazily high with extremely less jobs. Secondly, It's an "established fact" that he is an employee (don't give a damn if it's startup or a unicorn) and that if the work hours exceed the scheduled shift, then it's a violation as per Sec 51. If charged, then bear the fruits of penalty.
