Innovation-killing non-compete agreements are finally dying

In the wake of the OpenAI crisis, where employees threatened to quit and follow CEO Sam Altman to Microsoft, it was revealed that California's ban on noncompete agreements (NCAs) played a crucial role. California, alongside Oklahoma and North Dakota, had prohibited NCA enforcement. Now, spurred by research on NCAs' negative effects, 38 states have introduced 81 bills to ban or restrict NCA enforcement in 2023. A federal push is also evident, with the National Labor Relations Board and the Federal Trade Commission taking steps against NCAs at the national level.
