US drops suit against Southwest Airlines over chronically delayed flights Lawsuit Dropped: The U.S. Department of Justice has dropped a lawsuit against Southwest Airlines, initially filed by the Biden administration, for allegedly operating chronically delayed flights. Original Allegation: The Department of Transportation (USDOT) claimed Southwest had unrealistic schedules, citing two consistently delayed flights in 2022 (Chicago–Oakland and Baltimore–Cleveland). Southwest’s Response: Southwest welcomed the decision, stating delays were due to COVID-19-related challenges and largely beyond their control. Chronically Delayed Definition: According to USDOT, a flight is chronically delayed if it flies at least 10 times a month and is over 30 minutes late more than 50% of the time. No Pattern of Violations: Southwest stated that over 20 million flights since 2009 showed no other violations. .
