Have you created a unique code & want to safeguard it as intellectual property? Many mistakenly believe that computer codes can be protected as patents. In India, however, computer codes are protected under copyright law. By reading Sections 2(i), 2(ffc), 13, & 14 of the Copyright Act, it's evident that a computer program is classified as an original literary work, thereby warranting copyright protection. But if this same code integrates with hardware, like a mobile phone, it becomes eligible for patent protection. Why should you protect your code? To shield it from piracy. The most prevalent form of copyright infringement in software today involves the unauthorized downloading of free or cracked versions from online platforms—essentially, counterfeiting & pirating software. Section 63 of the Copyright Act stipulates that any infringement of copyright in a computer program or source code is punishable. Protect your innovation and ensure that your hard work isn't stolen or misused.
