1. The name, packaging, taglines, slogans or anything giving the identity to the brand can be trademarked. Let's take the example of a Chocolate with the name FineTaste. The logo, name, any slogan/tagline it uses and also the packaging as in the visual identity of its wrapper. Getting shapes as trademarked is complicated, in some cases it allows and in some it doesn't. The packaging will also be covered in trade dress. Recently we had settled a case where a big brand alleged our clients that our clients are using some elements of their packaging and trying to piggyback on their goodwill. 2. If you have invented a formula, you can approach for a patent and even a trade secret if you don't want it to be public. Take KFC for eg. 3. You can get the design registered for the packaging shape. How you design a bottle, can or a unique wrapper. 4. Copyright in the food industry will only apply if it contains any highly creative feature.
