The United States Patent and Trademark Office (USPTO) has issued guidance clarifying that AI systems cannot be named as inventors on patents. The USPTO states that only natural persons who make significant contributions to the invention can be listed as inventors. The guidance follows similar rulings by US courts regarding copyright ownership by AI models. While the use of AI in the creative process is allowed, significant human input is required for an invention to be patentable. The USPTO is currently seeking public comment on the guidelines.

India faces significant challenges in achieving AI innovation and research parity with the US and China. Despite a surge in AI-focused startups, the country lags in patents and groundbreaking research, with only 5% of the patents filed by China. This shortfall is attributed to limited foundational engineering, research, and development (ER&D) investment. Consequently, India’s AI endeavors are often secondary innovations, lacking the global economic influence of primary, patentable technologies.

Apple is reportedly planning to remove the blood oxygen functionality from its Apple Watch Series 9 and Ultra 2 models to bypass the import ban if its appeal is unsuccessful. The import ban was imposed due to a patent dispute between Apple and medical device maker Masimo regarding blood oxygen monitoring technology. Masimo claims that certain Apple Watch models infringe on its patents. The US Court of Appeals for the Federal Circuit is expected to rule on Apple's motion for a stay on the ban soon.

Chinese technology giant Tencent Holdings is facing the impact of broadened US restrictions on high-end chip sales to China. Tencent has a stockpile of AI chips from US maker Nvidia, with enough chips to continue developing AI models for the near future. However, the new rules will affect Tencent's cloud services where they sell computing power to clients. The company will now have to seek domestically produced alternatives to overcome the chip ban and find ways to make their AI chip usage more efficient.

The UK's supreme court has ruled that AI cannot be named as an inventor and receive patent rights. Computer scientist Stephen Thaler lost his attempt to register patents for inventions created by his AI system. The UK Intellectual Property Office had previously denied the request, stating that an inventor must be a human. Thaler's lawyers argue that the ruling shows the inadequacy of UK patent law in protecting AI-generated inventions. This decision follows similar judgments regarding copyright claims for artwork created by AI systems.

The Biden administration is reportedly considering placing restrictions on the export of advanced AI models, such as OpenAI's ChatGPT and Google DeepMind, in an effort to protect US AI from China. The Commerce Department may use a threshold based on the computing power required to train a model to determine which AI models would be subject to export restrictions. The US government is concerned that adversaries could use AI models to launch cyber attacks or create bioweapons. However, implementing export controls on AI models will be challenging, as many are open-source and defining the criteria for control will be difficult.
