Twitterโs music label legal trouble might have legs
The Verge

The lawsuit against Twitter, now known as X, by music labels for copyright infringement can proceed, as ruled by US District Judge Aleta A. Trauger. The judge denied X's motion to dismiss parts of the lawsuit, stating that it is still unclear to what extent X may be liable for the infringing acts of users on its platform. The National Music Publishers' Association (NMPA) sued X last year on behalf of major publishers, accusing the company of breeding massive copyright infringement. The judge allowed some of the NMPA's claims to proceed, including allegations related to X's premium subscription and its failure to respond to infringement claims in a timely manner. However, claims of direct copyright infringement and vicarious liability were dismissed.

Major record labels Sony Music, Universal Music Group, and Warner Records have filed lawsuits against AI companies Suno and Udio, accusing them of copyright infringement. The labels claim that Suno and Udio used their recordings without permission to train music-generating AI systems, enabling these systems to create music that directly competes with human artists. Suno and Udio users were allegedly able to recreate elements of popular songs and generate vocals that resembled famous musicians. The labels are seeking statutory damages of up to $150,000 per copied song. These lawsuits represent the first legal action against music-generating AI technology.

Microsoft and Google won't contest an EU law requiring easier user transition between competing services, like social media and browsers, under the Digital Markets Act (DMA). The DMA designates "gatekeeper" services from six major tech firms, including Alphabet, Amazon, Apple, Meta, Microsoft, and ByteDance. The law mandates interoperability and user choice. Microsoft and Google accept the gatekeeper label, but others, like TikTok, might challenge it. TikTok disagrees with its designation, while Apple and Meta have yet to respond to reports suggesting they might contest it. The deadline for complaints is Nov. 16.

Taylor Swift's music has returned to TikTok after a 10-week absence. However, only her more recent songs and "Taylor's Version" cuts, for which she owns the masters, are available on the platform. This comes after a licensing dispute between Swift's label, Universal Music Group (UMG), and TikTok. UMG accused TikTok of trying to undermine emerging artists by selectively removing their music while keeping popular artists on the platform. Swift's return coincides with the upcoming release of her new album, "The Tortured Poets Department," providing both marketing opportunities for her and audio trends for TikTok.

Technology has significantly impacted creative art forms such as music, film, and animation. The integration of technology and Artificial Intelligence (AI) in these industries has resulted in changes in music consumption and film production. Streaming services like Spotify and YouTube have revolutionized how people listen to music, allowing for personalized selection. In the film industry, the accessibility and ease of digital distribution have transformed the way movies are shared and consumed. However, human creativity and imagination remain essential in these fields, as technology cannot replicate the unique contributions of artists and composers. Copyright and legal issues also need to be considered when integrating AI into these creative processes.

TikTok is removing all songs written or co-written by Universal Music Group (UMG) artists from its platform as their battle over music rights continues. This decision not only affects UMG-signed artists but also those with publishing deals under the label, including Harry Styles and SZA. TikTok began removing UMG songs in February after failing to renew their licensing agreement. The platform claims UMG wanted an unfair deal that did not address concerns about AI-generated music and artist compensation. TikTok remains committed to reaching a fair agreement with UMG while allowing users to enjoy millions of other tracks.
