Did Amazon break India's competition law? We will know soon

India's Competition Commission is set to issue a notice to Amazon for alleged violations of competition law. The investigation wing of the commission has confirmed charges of anti-competitive behavior by Amazon Seller Services. The Commission will grant Amazon a hearing before issuing the final order with penalty, which could be up to 10% of the company's global turnover. The case is based on a complaint filed by a trade association in 2020, which prompted the commission to order an investigation. A similar case against Flipkart is also in progress. Experts emphasize that the high penalty should be applied judiciously to maintain market dynamism and encourage healthy competition.
