Correction: Tesla didn't sue for the "aforementioned reasons". They sued because the marks are exactly same marking to potential trademark infringement. Points to note: 1. It does not matter where your company is based in, what matters is who are your target customers/audiences and what goods/services are you providing. 2. In India, trans-border reputation has been a dicey one. In some cases the court has taken it into consideration but in majority of the cases it hasn't. However, if Tesla is able to show that it has customers in India as well, they will win the case. 3. In this matter the goods and allied & cognate if not same. Allied & Cognate means like I am into food industry then the beverage industry is allied & cognate to me.
