Supreme Court Overturns Chevron Rule in Blow to Agency Power

The US Supreme Court has nullified a long-standing legal doctrine that allowed federal regulators to interpret unclear laws, in a ruling that will restrict environmental and consumer protection agencies. In a 6-3 decision, the court overturned a 1984 case known as Chevron v. Natural Resources Defense Council, which had been used by previous administrations to support new regulations. The ruling shifts more responsibility to Congress to address policy issues through new legislation and grants greater authority to judges in limiting the actions of regulators when they overstep their authority. The decision follows previous attempts by the conservative-leaning court to curtail agency power.

As Supreme Court decisions loom, a legal assault is weakening SEC's power

A legal attack on the U.S. Securities and Exchange Commission (SEC) is eroding its ability to regulate Wall Street, with the Supreme Court expected to issue two rulings that could further limit its powers. The recent overturning of a major SEC rule on oversight of private funds by a U.S. appeals court is seen as a blow to SEC Chair Gary Gensler's efforts to increase transparency and clamp down on conflicts of interest. The ruling could also expose other SEC draft rules to legal challenges. Conservative-leaning courts have been used by business groups to challenge SEC rules and enforcement actions, part of a broader assault on federal agencies known as the "war on the administrative state". Gensler's aggressive agenda has made the SEC a prime target, as it oversees a wide range of entities with significant financial stakes. The agency is currently facing several lawsuits from financial firms and trade groups, accusing it of exceeding its authority and imposing burdensome regulations. Critics argue that weakening the SEC will harm ordinary Americans, while the industry says it is merely defending its profits. Despite the challenges, Gensler stated that the agency would adjust and adapt to adverse court rulings. The current litigation often alleges violations of the Administrative Procedure Act, which requires regulators to justify rules and consider public feedback. The Supreme Court is also expected to rule on two cases that could have significant implications for the SEC, one relating to its use of in-house judges for enforcement actions and the other challenging the "Chevron deference" doctrine, which requires judges to defer to federal agencies' interpretations of ambiguous laws. Both rulings could further curtail the SEC's authority and impact its ability to enforce regulations.

The US Supreme Court ruled that defendants have a constitutional right to present their cases to a federal jury when the Securities and Exchange Commission (SEC) seeks financial penalties. The decision could limit the SEC's ability to secure high-dollar settlements. The ruling also has implications for other governmental agencies that impose penalties through administrative proceedings, potentially affecting bodies such as the Federal Trade Commission, Agriculture Department, and Environmental Protection Agency. The decision is part of a broader trend in which the court is scrutinizing the power of regulatory agencies.

The US Supreme Court has ruled in favor of Starbucks in a case against the National Labor Relations Board (NLRB), making it harder for the agency to obtain temporary reinstatement for workers fired during strikes. The Supreme Court ruled that federal judges should review NLRB requests for immediate court orders in the same way they would review preliminary injunction petitions in private litigation. The decision will slow down the process and increase the burdens for the NLRB in obtaining immediate court orders, weakening one of the agency's most effective tools in protecting workers' rights.
