MakeMyTrip's plea against Google, alleging trademark infringement through the use of its registered trademarks as keywords in the Google Ads program, has been dismissed by the Supreme Court of India. The court stated that there is no possibility of confusion as users would not log into Booking.com if they intended to use MakeMyTrip. MakeMyTrip had previously obtained an injunction against Google and Booking.com, but it was later removed by the Delhi High Court. The case has now been referred back to the single judge for further clarification.

The Delhi High Court has removed the injunction on Google and Booking.com to use registered trademarks as keywords on the Google Ads program. MakeMyTrip had filed a copyright infringement case against the two companies, alleging that Booking.com had been bidding on the trademarks associated with MakeMyTrip in Google Ads. The court found that MakeMyTrip could not claim exclusive rights on the basis of the Trademark Act and that Booking.com's use of the keywords was unlikely to mislead users. This decision follows a recent restraining order against Dialmytrip, also initiated by MakeMyTrip.

The Supreme Court dismissed Zostel's appeal against Oyo, reaffirming the Delhi High Court's decision that Zostel holds no enforceable rights in a dispute stemming from a 2015 non-binding term sheet for an acquisition that never happened. The High Court had nullified a 2021 arbitral award favoring Zostel, thereby allowing Oyo to pursue shareholder actions, including its IPO, without potential claims from Zostel. The decision solidifies Oyo's stance in the litigation.

The Supreme Court dismissed PhonePe's appeal to prevent DigiPe Fintech from using the trademark 'DigiPe,' arguing that it infringed on PhonePe's registered trademark 'PhonePe.' The court noted that other companies already used the suffix 'Pe' in their names. The court also mentioned that the original lawsuit between PhonePe and DigiPe was ready for trial, refusing to interfere at this stage. The Madras High Court had previously rejected PhonePe's petition, stating that there were other trademarks with 'Pe' in the market and insufficient evidence to suggest customer confusion.

A U.S. judge has ruled that Google must face a proposed class action lawsuit from advertisers alleging that it has a monopoly over the ad exchange market. However, the judge dismissed other antitrust claims related to ad-buying tools used by large advertisers. The decision allows at least one key claim to proceed, stating that the advertisers have plausibly alleged antitrust standing in the ad-exchange market and the market for small advertisers' buying tools. The judge also ruled that Gannett, the largest U.S. newspaper chain, can pursue a separate case alleging that Google fraudulently concealed anticompetitive effects.
