Elon Musk claims he was offered shares in OpenAI but found it unethical or illegal to accept them. OpenAI, a nonprofit focused on AI development, was founded in 2015 with Musk pledging $1 billion. The company's recent valuation stands at around $80 billion. Musk left OpenAI in 2018 and cited disagreements with the team. He has been critical of OpenAI's partnership with Microsoft, stating that it prioritizes profit over its original mission. Musk has since launched his own AI company and released a competing chatbot.

OpenAI has responded to Elon Musk's allegations that its partnership with Microsoft goes against its initial mission as an open-source nonprofit. The response, which included snapshots of emails between Musk and OpenAI executives, was signed by five people including Ilya Sutskever. This is the first time Sutskever's involvement with OpenAI has been made public in months. Last year, Sutskever was involved in firing OpenAI co-founder Sam Altman, but later reversed his position and expressed regret. Musk had previously offered Sutskever a position at his own AI startup, xAI. Given Sutskever's role in OpenAI's response, it is unlikely he will accept Musk's offer now.

Elon Musk sued OpenAI and its CEO, Sam Altman, accusing them of violating their nonprofit mission by partnering with Microsoft. This move didn't sit well with OpenAI's backer, Vinod Khosla, who criticized Musk for not staying committed and engaging in a rival effort. Venture capitalist Marc Andreessen also took shots at Khosla, accusing him of lobbying to ban open source. Musk has been critical of Altman's leadership and stated that OpenAI has deviated from its original purpose of being an open-source, nonprofit company. Altman and his team believe Musk's grievances stem from regrets about not being involved with the company.
